Agreement to these Terms

These Terms of Use (“Terms”) are a contract between you and Final Quote, LLC (“Final Quote,” “FinalQuote,” “we,” “us,” or “our”). By using our websites or submitting a quote request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our sites. You must be at least 18 years old to use our services.

What Final Quote does (and does not) do

Final Quote is a lead-generation marketplace. We are not the contractor or service provider that performs the work, unless we clearly state otherwise. When you submit a request, we may match you with up to three (3) independent service providers, contractors, partners, lead buyers, or marketplace participants (each, a “Provider”).

• Providers are independent businesses. They are not employed, controlled, supervised, or guaranteed by Final Quote.
• Providers may pay Final Quote for your request, quote, call, appointment, introduction, referral, or a resulting transaction.
• We do not verify Providers and make no representation or guarantee that any Provider is licensed, insured, bonded, certified, background-checked, qualified, available, or appropriate for your needs. You are solely responsible for evaluating and selecting any Provider and for any agreement you enter into with them.

Any contract for services is strictly between you and the Provider. Final Quote is not a party to that contract and is not responsible for the price, quality, timing, safety, or outcome of any work a Provider performs.

Your responsibilities

You agree to:

• Provide accurate, current, and complete information in your requests;
• Submit your own contact information, or contact information you are authorized to provide, and only request services you actually want;
• Use our sites only for lawful purposes and not to submit false, misleading, fraudulent, or test/spam requests;
• Not copy, scrape, harvest, overload, disrupt, reverse-engineer, or attempt to gain unauthorized access to our sites or systems;
• Evaluate and confirm a Provider’s licensing, insurance, and qualifications yourself before hiring.

Consent to be contacted

When you submit a request, you authorize Final Quote and up to three Providers to contact you about that request by phone, text message, and email using the contact information you provide. Text messages may be automated; message frequency varies and message and data rates may apply. You can reply STOP to opt out of texts (HELP for help). See our Privacy Policy for details about how we collect, use, share, sell, and protect your information and your choices.

No professional advice; emergencies

Our sites and content are provided for general informational purposes and do not constitute professional, legal, financial, or other advice. Some requests may involve urgent or emergency situations; Final Quote does not provide emergency services and cannot guarantee a Provider’s response time or availability. In an emergency, contact 911 or the appropriate local authorities.

Disclaimers

OUR SITES AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the sites will be uninterrupted, secure, or error-free, or that any Provider will contact you, provide a quote, or perform any service. We make no warranty regarding any Provider or their services.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FINAL QUOTE, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF OUR SITES, ANY REQUEST, OR ANY DEALINGS WITH OR SERVICES PERFORMED BY ANY PROVIDER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITES OR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless Final Quote, LLC and its owners, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the sites, your requests, your dealings with any Provider, or your violation of these Terms or applicable law.

Intellectual property

The sites and their content, branding, and software are owned by Final Quote or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, revocable license to use the sites for their intended purpose. You may not reproduce, distribute, or create derivative works without our permission.

Third-party links and services

Our sites may reference or link to third parties, including Providers and service vendors. We are not responsible for third-party content, products, services, or practices, and your dealings with them are at your own risk.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Except where prohibited, you agree that any dispute will be brought exclusively in the state or federal courts located in or serving Hillsborough County, Florida, and you consent to their jurisdiction and venue.

Changes to these Terms

We may update these Terms from time to time. The “Last Updated” date shows when they last changed. Your continued use of the sites after changes are posted means you accept the updated Terms.
